Acuerdo Por la Paz Social y la Nueva Constitución
Ante la grave crisis política y social del país, atendiendo la movilización de la ciudadanía y el llamado formulado por S.E. el Presidente Sebastián Piñera, los partidos abajo firmantes han acordado una salida institucional cuyo objetivo es buscar la paz y la justicia social a través de un procedimiento inobjetablemente democrático.
1. Los partidos que suscriben este acuerdo vienen a garantizar su compromiso con el restablecimiento de la paz y el orden público en Chile y el respeto total de los derechos humanos y la institucionalidad democrática vigente.
2. Se impulsará un Plebiscito en el mes de abril de 2020 que resuelva dos preguntas:
a) ¿Quiere usted una nueva Constitución? Apruebo o Rechazo
b) ¿Qué tipo de órgano debiera redactar la nueva Constitución? Convención Mixta Constitucional o Convención Constitucional.
3. La Convención Mixta Constitucional estará integrada en partes ¡guales por miembros electos para el efecto, y parlamentarios y parlamentarias en ejercicio.
4. En el caso de la Convención Constitucional sus integrantes serán electos íntegramente para este efecto. La elección de los miembros de ambas instancias se ejecutará en el mes de octubre de 2020 junto con las elecciones regionales y municipales bajo sufragio universal con el mismo sistema electoral que rige en las elecciones de Diputados en la proporción correspondiente.
5. El órgano constituyente que en definitiva sea elegido por la ciudadanía, tendrá por único objeto redactar la nueva Constitución, no afectará las competencias y atribuciones de los demás órganos y poderes del Estado y se disolverá una vez cumplida la tarea que le fue encomendada. Adicionalmente no podrá alterar los quórum ni procedimientos para su funcionamiento y adopción de acuerdos.
6. El órgano constituyente deberá aprobar las normas y el reglamento de votación de las mismas por un quórum de dos tercios de sus miembros en ejercicio.
7. La Nueva Constitución regirá en el momento de su promulgación y publicación derogándose orgánicamente la Constitución actual.

8. Una vez redactada la nueva Carta Fundamental por el órgano constituyente ésta será someida a un plebiscito ratificatorio. Esta votación se realizará mediante sufragio universal obligatorio.
9. Las personas que actualmente ocupan cargos públicos y de elección popular cesarán en su cargo por el único ministerio de la ley al momento de ser aceptada su candidatura por el Servicio Electoral al órgano constituyente. Los miembros del órgano constitucional tendrán una inhabilidad sobreviniente para ser candidatos y candidatas a cargos de elección popular por un año desde que cesen en su mandato.
10. Los partidos que suscriben el presente acuerdo designarán una Comisión Técnica, que se abocará a la determinación de todos los aspectos indispensables para materializar lo antes señalado. La designación de los miembros de esta Comisión será paritaria entre la oposición y el oficialismo.
11. El plazo de funcionamiento del órgano constituyente será de hasta nueve meses, prorrogable una sola vez por tres meses. Sesenta días posteriores a la devolución del nuevo texto constitucional por parte del órgano constituyente se realizará un referéndum ratificatorio con sufragio universal obligatorio. En ningún caso podrá hacerlo sesenta días antes ni después de una votación popular.
12. El o los proyectos de reforma constitucional y o legal que emanan de este Acuerdo serán sometidos a la aprobación del Congreso Nacional como un todo. Para dicha votación los partidos abajo firmantes comprometen su aprobación.
Agreement for Social Peace and the New Constitution
Faced with the serious political and social crisis in the country, attending to the mobilization of citizens and the call made by H.E. President Sebastián Piñera, the undersigned parties have agreed on an institutional solution whose objective is to seek peace and social justice through an unobjectionable democratic procedure.
1. The parties that sign this agreement come to guarantee their commitment to the restoration of peace and public order in Chile and the total respect of human rights and the current democratic institutions.
2. A Plebiscite will be promoted in April 2020 that will resolve two questions:
a) Do you want a new Constitution? I approve or reject
b) What type of body should draft the new Constitution? Mixed Constitutional Convention or Constitutional Convention.
3. The Mixed Constitutional Convention will be made up of equal parts by members elected for this purpose, and parliamentarians in office.
4. In the case of the Constitutional Convention, its members will be fully elected for this purpose. The election of the members of both instances will be carried out in October 2020 along with the regional and municipal elections under universal suffrage with the same electoral system that governs the elections of Deputies in the corresponding proportion.
5. The constituent body that is ultimately elected by the citizens, will have the sole purpose of drafting the new Constitution, it will not affect the competences and attributions of the other organs and powers of the State and will dissolve once the task entrusted to it has been completed. Additionally, it may not alter the quorum or procedures for its operation and adoption of resolutions.
6. The constituent body must approve the rules and voting regulations for them by a quorum of two thirds of its members in office.
7. The New Constitution will govern at the time of its promulgation and publication, organically repealing the current Constitution.

8. Once the new Fundamental Charter has been drafted by the constituent body, it will be submitted to a ratifying plebiscite. This vote will be carried out by compulsory universal suffrage.
9. People who currently hold public and popularly elected positions shall cease in office by the sole ministry of law at the time their candidature is accepted by the Electoral Service to the constituent body. The members of the constitutional body will have a supervening inability to be candidates for positions of popular election for one year from the end of their mandate.
10. The parties that sign this agreement will designate a Technical Commission, which will focus on determining all the essential aspects to materialize the aforementioned. The appointment of the members of this Commission will be equal between the opposition and the ruling party.
11. The term of operation of the constituent body will be up to nine months, extendable only once for three months. Sixty days after the return of the new constitutional text by the constituent body, a ratifying referendum with compulsory universal suffrage will be held. In no case may it do so sixty days before or after a popular vote.
12. The constitutional and or legal reform project (s) that emanate from this Agreement will be submitted to the approval of the National Congress as a whole. For said vote, the undersigned parties undertake their approval.
